Deposit:
Definition: The term "deposit" in this context refers to a non-refundable holding fee. Once the deposit of $350 is placed, it serves as a commitment to purchase, preventing others from acquiring the puppy. Due to the non-refundable nature of the deposit, it will not be returned.
Placing a Deposit: By making the deposit, the Purchaser acknowledges and agrees to these terms.
Deposit Payment Methods: Personal checks are accepted for the deposit, but the check must clear to be considered a valid hold on the puppy. PayPal, Venmo, or money orders are also accepted as forms of payment. The buyer is responsible for any fees associated with digital currency transactions. The full price value of the pup must be paid despite additional payment fees.
Remaining Balance: The remaining balance must be paid in full before the puppy leaves the breeder's premises. The puppy will not be released until the entire purchase price is paid in full.
Entire Agreement: This contract represents the entire agreement between the Breeder and the Purchaser in an outright sale. By making the deposit, the Purchaser acknowledges and agrees to the terms outlined in this contract.

Buyer’s Responsibilities:
Holding Fee (Deposit): A non-refundable holding fee (deposit) of $350 is required to secure a puppy. Once the deposit is made, the buyer will provide a receipt stating the payment, sex/color preference, and pick order number. The deposit will not be refunded for any reason.
Buyer Default: The buyer acknowledges that if they fail to complete the purchase or pay the balance within 3 days of the agreed-upon go-home date, the holding fee will be forfeited, and the reserved puppy may be offered to the next person on the waiting list with no refunds given.
Shipping and Transportation Costs: The purchaser is responsible for all shipping and transportation costs, if applicable, to be paid to the breeder before the shipping of the dog.
Breeder’s First Pick: The buyer understands that the breeder reserves the first pick if she chooses to keep a puppy at any time.
Responsible Ownership: The buyer commits to providing a life-long commitment, a comfortable environment, prompt medical attention, adequate exercise, proper grooming, and responsible care for the puppy, including keeping them parasite-free and up to date with vaccinations. The buyer is responsible for all veterinary costs.
Rehoming: If the buyer is unable to keep the puppy, they agree to contact the breeder immediately for assistance in finding a new home. Under no circumstances will the puppy be placed in an animal shelter, pound, or pet store. No refund will be given if the buyer no longer wants the puppy. Breach of the contract or placing the puppy elsewhere without the seller's agreement renders the contract null and void.

Agreements:
Change in Contact Information: Buyer agrees to promptly notify the breeder of any change in address or contact information via email or phone. Current contact information for Julie Caywood will be maintained on the Caywood Aussies Facebook page and www.caywoodaussies.com website.
Registration Papers: Correct registration papers will be provided to the buyer upon puppy pickup. The responsibility for the registration fee lies with the buyer. The breeder will handle the submission of papers for registration, if required. All registered puppies must have the breeder's name "Caywood's" at the beginning of their registered name.
Full Registration and Breeding Rights: The buyer must purchase full registration and breeding rights from the seller at the time of puppy pickup as part of the total breeding cost.
Restrictions on Breeding: The buyer is prohibited from breeding a toy or mini American Shepherd. The buyer agrees not to breed merles to other merles of any color. The buyer commits to refraining from breeding before the puppy reaches 24 months of age.

Health Guarantees:
General Health Warranty: Breeder warrants and guarantees that the dog is in good health at the time of sale. The health guarantee does not cover any parasites, internal or external, as this is a treatable condition. Please reference vet records for additional information. All records are given to the seller, and the seller acknowledges the vet records.
Veterinary Examination: The Breeder strongly encourages the Purchaser to have the dog seen by a veterinarian of the Purchaser’s choice within 72 hours of picking up the dog. If, during the first 72 hours, the dog is found to be unhealthy by a licensed veterinarian, please send proof via email. Please refer to vet records given at pickup. When you sign this paper, you acknowledge vet records were given, and you were made aware. The Breeder will not refund any veterinary fees under any circumstances.
Congenital Defects: All congenital defect claims must be accompanied by documentation by a licensed veterinarian, including any and all testing. The Breeder retains the right to take the dog to a veterinarian of her choosing to verify the diagnoses; this is the only visit paid for by the breeder. Breeders will not refund any veterinary fees under any circumstances.
Uncontrollable Factors: Buyer understands that factors such as temperament, potty training ability, size of dog, length of hair, color of eyes, re-growth of dewclaws, testicles dropping, or any uncontrollable factors cannot be guaranteed because they can change as the puppy develops.
Timeline for Claims: Buyer agrees to report any health concerns or issues observed after the initial 72 hours within a reasonable timeframe for consideration under this health guarantee.
Refunds and Dispute Resolution: No refund or exchange will be provided for any reason if the dog has been mistreated, neglected, malnourished, injured, or physically altered by the buyer(s). Once the puppy has left the premises of Caywood Aussies, there are no refunds.
In the event of a dispute or disagreement between the buyer(s) and the seller, the parties agree to enter into good-faith negotiations to explore potential resolutions. If, after a reasonable effort, an agreement cannot be reached, both parties may seek mediation or arbitration as a non-litigious means of resolving the dispute.
Rehoming Assistance: If, for any reason, the buyer(s) are unable to keep the puppy, Caywood Aussies will actively collaborate with the buyer(s) to find a suitable new home. However, under no circumstances is the seller obligated to have the dog returned to Julie Caywood or Clint Caywood or Caywood Aussies.
Individual Circumstances: Acknowledging the variability in individual dog behavior and recognizing the presence of our human children, Caywood Aussies understands that each breeder may have unique circumstances. In our situation, we are committed to providing assistance and support as best we can while prioritizing the safety and well-being of our family.
Evaluation Process: Caywood Aussies reserves the right to evaluate each rehoming situation individually. Due to our commitment to protecting our children, there may be specific conditions or limitations regarding the return of dogs to our property. We appreciate the understanding of our buyers in this matter.
Commitment to Well-being: Caywood Aussies is unwavering in its commitment to the well-being of its puppies and will continue to work closely with the buyer(s) to ensure a positive outcome for the dog's future.
Breach of Contract: It is stipulated that in the event that the buyer(s) fail to comply with any of the terms or conditions of this sales contract, Seller will have all rights to demand the return of the dog, and the dog shall be returned. In the event that the dog is permanently returned to the seller due to the buyer(s)’s lack of compliance with any terms and conditions in this contract, the buyer(s) will forfeit all money paid to the seller and will sign registration papers over to the seller. All legal issues to be brought to a court local near Caywood Aussies instead of near the buyer.
Hold Harmless Agreement: Buyer agrees to release and hold seller harmless for any and all liabilities, damages, or injuries, caused either directly or indirectly by dog/puppy to any person or animal, whether actual or legal, or to any property whether real or personal. Furthermore, Buyer assumes full liability for any damages or injuries, whether physical or mental, emotional or economical, caused by dog/puppy to any person, whether actual or legal or to any property whether real or personal, after acknowledging delivery and possession of the dog/puppy. By signing below Buyer(s) and Seller listed on this document acknowledge that they have read and understood the above and agree to abide by the terms of this agreement.
